I also have some pretty serious heart complications, and high blood pressure and diabetes type stuff and gobs of other stuff wrong with me.  I was on over a dozen medicines daily!  The hospital that I was in had me fill out the application for disability – I would never have thought of it.  I’ve never known anyone who was on it. Since then, as with the other 70% for first time applicants, I was denied flatly. And with the other 85% of folks who don’t give up, but ask for a Reconsideration, I was turned down flat. So I got a S.S. Disability attorney, and we requested a hearing.  The appeal with the judge is Friday. I have learned many things over these long, difficult years – about the system and how to use the advantages. What I know that I know is an applicant must have written proofs, such as medical test results.  I had 4 doctors who wrote letters saying I was disabled back 3 years ago when I first applied.  But they were thrown out – I was told that a doctor is not a vocational expert and cannot make a disability determination.   They can only report facts, such as test results. When my SSD attorney saw my medical records he said: this is 300 pages of bla, bla, bla.  We only get 59 minutes in front of the judge.  And he proceeded to "start over" getting the doctors, and therapists to write very specific language. So last time I had a very good case by MY standards and it went no where. This time, I have a pretty good case by THEIR standards.  Also, I am older, which helps a person get approved, and have more than one illness documented. If I didn’t know the system at all, I’d say I’d win it this time.  But knowing the system, nothing is sure.  I now know that the judge has (and relishes) total power and we have to feed him what he wants, how and when he wants it.  Of all the Administrative Appeals Hearing Judges in Tennessee, the guy I was assigned to is considered the toughest – so who knows. I do know that the judge has up to six months to make their decision, and if approved, up to 6 months to make the back-payments after that.  So even IF I am approved, it could be a long wait before I get the 75% of whatever is available.  (25% to attorney) I think the maximum is 24 months back pay – and they hold back 5 months as a deductible.  So they still haven’t gotten into a person’s pocket unless they take longer than 29 months to make a ruling. Start to finish will have been about 5 years – for what common sense would have approved the first time…however, rather than griping about what I’ve missed, I’ll just be grateful if/when it is finally settled. Well, really … that’s the most important thing. I looked at the site and I found things that I didn’t know, either. Contrary to some opinions, the issue isn’t "contact with the world" nor "average intelligence." It’s whether or not one has had the time, need and/or opportunity to familiarize oneself with this information. I haven’t. Good luck with your hearing. It sounds like you’ve been pursuing this for a long time. Kathie

As I was looking for something else, I found this site: http://www.disabilitysecrets.com/ It says:         The purpose of this site is to distribute         information—crucial information that, nine times         out of ten, it’s impossible to get from the person         taking your claim for Disability and ssi benefits.         In essence, applying for disability and ssi benefits         might as well be a secret process since Social         Security does not try to make this information         clear or even understandable. I haven’t read much of it, so I can’t vouch for the information, but perhaps someone with more experience with the process can comment on it. Kathie
